These terms cover your use of iDEAL Subscriptions Abakira (“the app”), a Shopify app run by Abakira LLC (“we”, “us”). By installing the app you accept them. If you don’t, don’t install it.
1. What the app does
It lets buyers who pay with iDEAL or Bancontact subscribe to your products. The first order is paid in your normal Shopify checkout through your Mollie payment app. The app then creates a SEPA Direct Debit mandate in your own Mollie account, sends a direct debit for each next delivery on the schedule the buyer chose, and records each paid delivery as a Shopify order. Buyers can pause, resume or cancel from a page on your store. We change features over time, and we try not to break running subscriptions when we do.
2. Plans and billing
There is a free plan and a paid plan. Their prices, limits and what each one includes are in the pricing section of the app’s page on the Shopify App Store, and in the plan section inside the app. Our fee is billed by Shopify, through your Shopify invoice. We never take a cut of your payments. You can change or cancel your plan at any time from the app.
A plan limit never stops a running subscription. When you reach it, the subscribe option is only hidden from new buyers.
3. Your Mollie account and your responsibilities
- You need your own Mollie account with SEPA Direct Debit enabled by Mollie. You give the app an API key of that account; we store it encrypted and use it only to run your subscriptions. Mollie’s terms apply between you and Mollie, including its fees for debits, failures and chargebacks.
- You are the creditor of every direct debit. You make sure your products, prices, delivery promises and the authorisation text shown to buyers meet the law where you sell, including SEPA rules on mandates and notice before a debit.
- You handle refunds, disputes and questions from your buyers. A failed debit or a chargeback is shown to you in the app and is not retried automatically.
- You keep your Shopify and Mollie accounts secure, and you don’t use the app for anything unlawful or try to disrupt it, other merchants, Shopify or Mollie.
4. Your data
What we collect, why, and how long we keep it is in the privacy policy. It is part of these terms. You remain the controller of your buyers’ data; we process it on your behalf.
5. Money
We are not a payment processor and never hold funds: every payment goes from the buyer to your Mollie account. The amount of a subscription is fixed when the buyer subscribes, and the app never debits a different amount. If an order for a delivery cannot be created in Shopify after a debit succeeded, the app shows it to you so that you can fulfil it.
6. Uninstalling
You can uninstall the app at any time from your Shopify admin. We then delete your Mollie API key and no further debit is sent. The mandates stay in your Mollie account, so another tool can take them over. We delete what we hold for your shop as described in the privacy policy.
7. No warranty, limited liability
The app is provided “as is”. We don’t promise it will be free of errors or always available, and we don’t promise any level of sales. To the extent the law allows, we are not liable for indirect or consequential damages, such as lost sales or lost data. Our total liability for any claim is limited to what you paid us for the app in the 12 months before the claim, or $100 if you are on the free plan. Nothing here limits a liability the law does not allow us to limit.
8. Suspension and termination
We can suspend or end your access if you seriously breach these terms and don’t fix it after we tell you, or if Shopify, Mollie or the law requires it. You can stop at any time by uninstalling.
9. Changes to these terms
When we change these terms, the date at the top changes. If you keep using the app after that, you accept the new version.
10. Governing law
These terms are an agreement between you and Abakira LLC. They are governed by the laws of the State of New Mexico, United States, without regard to its conflict of laws rules. Any dispute about them or about the app goes to the state or federal courts located in New Mexico, and you and we both accept their jurisdiction.
